When it comes to a wrongful death lawsuit, you need an attorney you can trust: someone who will return your phone calls right away, keep you up to date on how the case is proceeding, and answer all of your questions in full. When I take on a wrongful death case, I give it top priority and make myself available to my client for whatever they might need.


Do I need a wrongful death lawyer?


In the state of Florida, the letter of the law dictates that your loved one’s “personal representative” (as outlined in their will) must be the one to file a wrongful death lawsuit. The suit itself will be filed on behalf of your loved one’s estate, and any damages are generally allocated to family members. The lawsuit must be filed within two (2) years of the date of death in order to hold up in court.


A wrongful death case is much more complex than the average personal injury case. As the party bringing the lawsuit to court, you’ll need to demonstrate that another party’s wrongful act, negligence, default, or breach of contract was directly responsible for your loved one’s death. This is far from simple, and requires an attorney with extensive experience in order to properly represent you.
